Oklahoma Marijuana Law 101

SQ788 allows Oklahoma residents with a medical marijuana recommendation to apply for a medical marijuana patient license. A medical marijuana patient license allows an individual with an approved application to legally buy, use, and grow medical marijuana and medical marijuana products in Oklahoma. This license will be in the form of an identification card that can be used to prove an individual is a license holder. This card will contain the individual’s name, photo, date of birth, city and county of residence, the type of license, the date the license expires, and the patient’s unique medical marijuana license number. The license application can be found at omma.ok.gov.

Medical Marijuana patient license holders are allowed to possess up to:

  • 3 ounces (85 grams) of marijuana on their person;
  • 8 ounces (226 grams) of marijuana in their residence;
  • 1 ounce (28.35 grams) of cannabis concentrates;
  • 72 ounces (2.04 kg) of edible cannabis products;
  • 6 mature marijuana plants
  • 6 seedling marijuana plants

Medical Marijuana patient license holders are allowed to purchase up to:

  • 3 ounces (85 grams) of marijuana on their person;
  • 1 ounce (28.35 grams) of cannabis concentrates;
  • 72 ounces (2.04 kg) of edible cannabis products;
  • 6 mature marijuana plants
  • 6 seedling marijuana plants

An Oklahoma resident may apply for a patient caregiver’s license for a patient who has a physician's attestation that the patient is homebound or does not have the capability to self-administer or purchase medical marijuana due to developmental disability or physical or cognitive impairment and would benefit by having a designated caregiver to manage medical marijuana on the behalf of the patient. The license application can be found at omma.ok.gov.

Out-of-state residents with a valid, un-expired medical marijuana license may apply for a 30 day temporary license. The application requirements can be found at omma.ok.gov.

Types of Marijuana

Cannabis Flower

Cannabis flower refers to the flowers that bloom from a male or female cannabis plant. Flowers from the female cannabis plants produce THC, as well as other cannabinoids found in the cannabis plant, at much higher levels than the flowers from male cannabis plants. If female cannabis plants go unfertilized by male plants, they continue to produce cannabinoid rich resin until they are harvested. Once the cannabis flowers are harvested, dried, and cured they can be smoked, vaporized, or used to make cannabis concentrates and cannabis-infused edibles.

Cannabis Concentrates

Cannabinoids from dried cannabis flowers can extracted, and processed in a number of ways to yield a variety of cannabis concentrates such as wax, live resin, rosin, shatter, distillate, etc. These extraction methods pull all of the active cannabinoids from the plant matter into a very potent concentrated form of cannabis. The cannabis concentrates can then be vaporized or used to make cannabis-infused edibles.

Cannabis Infused Edibles

Dried cannabis flower and cannabis concentrates can be used to make cannabis-infused edible products such as gummies, baked goods, caramels, chocolates, drinks, and almost any food item you could imagine. When cannabis products are ingested orally, the THC molecule is processed through the liver and broken down to a THC derivative called 11-hydroxy-THC. Because 11-hydroxy-THC can produce much stronger psychoactive effects than one would experience from smoking dried cannabis flowers, patients are encouraged to be cautious when taking cannabis-infused edibles.
